Permanent Residency: I-130 Form

At Mexus Immigration Services, one of our top services is professional counseling to process the American Residency or Green Card. So through the USCIS department, an American Citizen or Permanent Resident can obtain a Green Card for any of their direct relatives.

We mainly attend procedures through the Consulate. It means that the applicant is in Mexico, and the process to obtain the Immigrant Visa is carried out at the American Consulate in Ciudad Juárez.

Many people think that in Ciudad Juarez, their relative will receive the American Residency. But, at the interview in the American Consulate, if the procedure is approved, your relative will receive an Immigrant Visa. That is, the document for your family member to enter and once inside the United States make the payment of "USCIS Immigrant Fee" and eventually receive their LPR (Permanent Residence).

The process begins with the correct completion of the I-130 form. First, you must select the category for a relative you are applying for the permanent residence, as they vary depending on how “immediate” your relative is. For example, it is not the same length for a procedure for a child under or over 21 years old.

The National Visa Center regulates some family member categories of Immigrant Visas allowed to be processed each year. But, some categories are considered immediate, like an American Citizen requesting a spouse, parents, or a child under 21 years of age.

Before starting the procedure, verify that the immediate family member you wish to request belongs to a viable category, and thus you will be able to obtain an estimated time of the duration of the procedure.

Once the I-130 form is submitted at USCIS to process the American permanent residency, it can regularly take between 6 and 12 months for it to be approved since, among other factors, it depends on the category of the immediate family member and the corresponding Jurisdiction.

Once the I-130 form is approved, the USCIS department (U.S. Citizenship and Immigration Services) will notify the National Visa Center (NVC) that will provide a case number for the American Consulate in Ciudad Juárez.

The case number regularly begins with the initials CDJ and an ID number. Using it, you will have access to your account on the website "Consular Electronic Application Center" and continue to the next stage of the procedure at the American Consulate until you obtain the Immigrant Visa for your immediate family member.

Finally, once NVC verifies and accepts all your documents, you will be officially “waiting for your appointment” at the American Consulate in Ciudad Juárez.

We resent this section and all its content with the intention that it is an informative guide to support you with the process of American Residency or Green Card for you and your immediate family member.

But each particular case is different, and times may vary, depending, among other factors, on the number of documents to be entered or on having a criminal record in the United States.

What the Green Card is?

The American Permanent Residency or Green Card is the document that identifies a person as a Permanent Resident in the United States. Any holder of a Green Card has the right to live and work permanently and legally in the United States, without being an American National.

The Green Card holder must carry it at all times to avoid any problems with the immigration authorities of the United States.

There are different ways to apply for a Permanent Residence or Green Card. For this reason, we recommend hiring the consulting service of an expert Migration Lawyer to carry out the process most effectively and safely.

The main ways to apply for the Green Card are:

  • Residence at the request of a direct relative.
  • Residence at the request of an employer.
  • Residence by investment.
  • Residence by marriage.
  • Through the visa diversity program (visa lottery).

When processing the Green Card for the first time, it is necessary to comply with one of the previously authorized ways.

The Immigration authorities of the United States are extremely demanding with the requirements of this procedure. Getting professional help from an expert immigration advisor will result in getting the Residency successfully since any error in the application may result in the Green Card denial.

When an expert immigration adviser carries out the procedure, even a deported person can obtain American Residency through a prior request of a Waiver.
