It is commonly known as a Fiancé Visa, although it is not a procedure only for engaged couples. The initial application in the USCIS department made through form I-129 (F) “Petition for Alien Fiancé or Fiancée (a), to apply for a K-1 nonimmigrant visa, for people who do NOT are still married, since the K-1 visa allows the fiancé (e) to enter the United States to marry within the next 90 days.

On the other hand, there is the possibility of requesting the K-3 Visa, when the couple is already married, it is necessary to enter Form I-130 and have the case number before USCIS, so they can send the I-129 form- F to apply for the K-3 Visa, which will allow them to enter the United States to continue with their immigration procedure.

PROCESS

The first step is to present the I-129 F form at the USCIS department, which will start your immigration process. Verify the USCIS jurisdiction that will process the form, as each jurisdiction has different processing times.

During the process, USCIS may ask you to present additional information (Request of Evidence), you must answer within the period stipulated in the notification.

Once your case is approved, you will receive the approval notification from USCIS. Later you will receive another mail from the National Visa Center (NVC), with the case number to be attended at the American Consulate in Ciudad Juárez, Mexico

Once you obtain your case number from NVC, you must fill out the DS-160 form and select the K-Visa option, specifying whether you need the K-1 visa or the K-3 visa.

Later, once you have completed your DS-160 form, you must create an account with the Immigrant Visa department to continue your process.

Once you have an account created at the Visa department, you must continue to schedule your appointments for fingerprinting and photographs, for the interview at the American Consulate, and your medical exams, all in Ciudad Juárez.
